Don't leave it too long before you do something, if they still haven't answered your emails by Monday (Paypal say that sellers must send you your item within a week of it being paid for) open a dispute for item not received, give it 2 days max after that and then escalate it into a claim for your money back.
He replied, he was out of the office all week and no one else answered the mail.
He has said he sent it that day I expect it will take a week at least to get here.
